FBI Agent Charged with Sexual Assault and Linked to Past Shooting Case

Key Details

An FBI special agent, Eduardo Valdivia, has been arrested in Maryland on charges of sexually assaulting two women. Valdivia, previously acquitted in a 2020 off-duty shooting incident on a Washington, D.C., Metro train, now faces multiple felony and misdemeanor charges, including two counts of second-degree rape.

The Charges

  • The alleged assaults occurred in May 2024 and September 2024, according to court records.

  • Valdivia, 40, was arrested Monday and is currently in custody. He is scheduled for a bond hearing on Tuesday.

  • Montgomery County Police detectives suspect there may be additional victims and plan to hold a press conference to encourage others to come forward.

FBI Response

The FBI confirmed Valdivia’s suspension pending the investigation.

  • "The FBI takes allegations of criminal violations and misconduct very seriously," said an FBI spokesperson, noting the agency is cooperating fully with local authorities.

No additional details have been provided by the FBI due to the ongoing investigation.

Previous Shooting Case

Valdivia was acquitted in 2022 of charges stemming from a 2020 incident where he shot and seriously injured an unarmed man during a confrontation on a Metro train near Bethesda, Maryland.

  • Prosecutors alleged Valdivia escalated a verbal altercation into violence. The victim required extensive surgery to remove parts of his spleen, colon, and pancreas.

  • Valdivia claimed self-defense, arguing the man approached him aggressively, creating a perceived threat.

  • A Maryland jury found Valdivia not guilty of attempted second-degree murder, first-degree assault, and related charges.

Defense Position

Robert Bonsib, Valdivia’s defense attorney, represented him during the shooting case and now in the sexual assault charges.

  • "We don't accept at first blush any of the allegations until all of the evidence is in," Bonsib said.

Valdivia joined the FBI in 2011 and was promoted to supervisory special agent in 2019. He had resumed his duties after his 2022 acquittal.

What’s Next?

  • Valdivia remains in custody pending his bond hearing.

  • Montgomery County Police are investigating the current charges and seeking potential additional victims.

This case highlights growing scrutiny of accountability within law enforcement agencies. Further developments are expected as investigations proceed.
